Former NBA star Lamar Odom could face a felony drug charge after being found unconscious at a Nevada brothel last month.
Nye County district attorney Angela Bello said the sheriff's office submitted the potential charge last week and that a prosecutor is considering filing a count of unlawful use of cocaine or being under the influence of a controlled substance.
Authorities investigating a possible overdose by Odom got a warrant on 13 October to take a blood sample while he was in a critical condition in hospital.
The estranged husband of Khloe Kardashian had spent four days at the Love Ranch when he was found unresponsive in his room.
Staff said they saw him drink alcohol and take supplements sold as "herbal Viagra".
The Kardashians flew to Odom's bedside after his medical emergency.
Khloe told Ellen DeGeneres' talk show on Monday that Odom faces a long recovery.
He is reported to be having trouble speaking after suffering a stroke and is learning how to walk again.
Ms Bello declined to discuss details of what is expected to be a weeks-long investigation by her office.
Odom spent most of his 14-year NBA career playing for the Lakers and the Los Angeles Clippers.
In the 2000-01 season, he was suspended after twice violating its anti-drug policy.
Odom was raised by his grandmother after his mother died of cancer when he was 12 years old. His father was a drug addict.
In 2006, his six-month-old son Jayden died from sudden infant death syndrome as he slept in his cot in New York.
