THE families of four Australian MH370 passengers are seeking more than $200,000 compensation from Malaysia Airlines for the deaths of their loved ones.
Close friends Bob and Cathy Lawton and Rodney and Mary Burrows were among 239 people on board the flight from Kuala Lumpur to Beijing that mysteriously disappeared more than two years ago.
The couples’ adult children have lodged a claim in the Federal Court of Australia accusing the airline of not doing enough to prevent the Boeing 777 from flying off course and vanishing.
The document states that Malaysia Airlines “failed to take any adequate precautions for the safety of passengers and exposed the passengers to a risk of injury which could have been avoided by reasonable care”.
Malaysia Airlines also “failed to prevent the flight from being operated in a manner that caused it to crash”, the claim says.
Compensation is sought for varying degrees of nervous shock and subsequent economic loss suffered by the couples’ children, as well as for memorial expenses and the cost of administering the estates.
The four friends were heading off on the trip of a lifetime to Beijing, after Mr Burrows took a redundancy from Energex with plans to travel the world.
The claim is not dissimilar to that filed in the Victorian Supreme Court by Melbourne’s Jennifer Chong over the death of her husband Chong Ling Tan.
Her claim also accuses Malaysia Airlines of negligence for not keeping track of its own aircraft.
MH370 is thought to have crashed into the southern Indian Ocean after being deliberately flown off track just 40-minutes after takeoff.
Despite an extensive underwater search costing $180 million, no trace of the Boeing 777 has been found on the ocean floor.
However a number of pieces of debris confirmed as coming from the aircraft have washed ashore on Reunion Island and in Mozambique.
Other items found in Mauritius and South Africa are being analysed to confirm their origins.
Under the Montreal Convention, Malaysia Airlines is required to pay compensation to next of kin but that amount may vary.
A number of cases filed in Malaysia have settled out of court.
